Hi,

EBay is freaking me out. I just went over 37 pages of orchid listings and
found 5 pictures from my website being used to sell plants by two different
sellers. I had no idea. I also figured out why, for eBay orchid sellers,
it might be a good idea to get the name wrong. If a potential customer
types a correctly written name into a search engine they will find out what
vendor the seller bought the plant from. This will tell them, among other
things, just how "rare" it really is.

And the word "rare" couldn't get any more meaningless after 37 pages,
especially when it is most frequently listed next to various orchids that
costs between $9.99 and $14.99 plus shipping.

And for anybody who wants to win a free visit into their very own head from

Yeah, but all the plants to which this amabilis was supposedly crossed
are standards whites as well! Pink just ain't gonna happen....

I've bought from this jirk and his plants are bare rootless dried out and
almost dead and shipping is thrown into a boc with a few strands of
schreaded paper and sent regular parcel post so that they get beat up even
more. Oh yeah one even bloomed, i guess from shock, and it wasn't even what
I bought. right if I sent it back and payed even more shipping he says he's
replace it, I may be crazy but I'm not stupid.

That is a good link to keep. It took me three tries to get into
the location where a copyright holder can complain. I kept being
told if I did not buy from him I can not complain.

We had one posted in Canada - You could see the name of the
plant, the copyright and John's name in the displayed photo on
the listing. He inferred that the plant he was selling was in
the photo. When I asked him to remove it, I got nothing. When I
turned him in, he said how was he to know it was copyrighted.
When I said that is what it says on the front of the photo, I
was threatened. He said he would turn me in the Embay for
harassment. The good thing is that Ca Embay is doing a customer
service survey... how good are we? I complained that they did
nothing and acted to slow. Maybe it will impact the future.

Thank you Dusty, I have just returned from faxing my "Notice of Claimed
Infringement" affidavits to EBay's VeRO program office.

I hope it does some good. One of these people is already giving me the same
run around as Sue reported and another is doing some comic posturing and
rationalizing of his own.

It is my understanding that it is up to me as the owner and publisher of my
site to obtain written permission from the owners of pictures and other
content before I publish them. I believe this to be a far more prudent
course of action than requiring owners of property to prove it is theirs
before I remove it. I think it is far better to fess up and apologize when
caught. That is what I would do, er did... but that's a story I will never
tell or even hint at.

I suppose Xi Wang gets the prize. Sadly, it has just been pointed out to me
that the owner's manual prohibits space aliens living in one's head from
being given out as door prizes, so I will have to humbly apologize for
offering a prize that was not mine to give. I can only hope Xi feels
somewhat less disappointment than I do at this turn of events.

Well, actually he implied it. The person viewing the sight would infer
it.

to my sites. I can't imagine why they are linked there... one is something
called 3marketeers and another is a spam blog stopper..... bwuh?

If eBay is freaking you out, Al, now linkers are freaking me out! I think
there are 6-7 orchid related external links to the pac central page, there
are 5-6 from these marketing groups.... ?

I'm very pragmatic about linkers.
If I notice someone excessively linking, I haul out the apache plugin
that lets you change which documents are served depending on the referrer.
The linkers suddenly start getting goatse, photos from the birth of modern
plastic surgery, this month's flesh rotting disease from the journal of
dermatology....

Anyhow, back on topic. I have an urge to add more cymbidiums and
was wondering if the Ebay deals for Dark Falls Orchids were worth it,
or if there were other places ya'll would suggest someplace else for
miniatures?
(I'm aware of Oak Hill Gardens, just wish they had more pictures).

That VeRo program really kicks! All the listings I had included were
removed just one hour after I sent the fax.

One lady responded to my emailed complaint (sent out prior to the VeRO fax)
with so much grace that I gave her permission to use my photos if she gave
me photo credit. The other one, on the other hand, managed with his
response to actually activate my Y chromosome. It has been a long time and
the aliens probably thought it was turned off for good. I had forgotten
why your race has so many problems with war and aggression. But now that it
is activated I suppose the chips will fall where they will fall. Oh gee and
I though I might actually make a profit this year even with my oil bill.
Now I will HAVE TO deal with lawyer fees. Yes, that Y chromosome can be a
problem. It actually made me use the "L" word, even if only here. Only
stupor induced y chromosome driven people throw the 'L" word around.

I always recommend Oak Hill. Send an email and ask Greg if he
has a photo of what your interested it.

When a ebay seller linked to our site it created quite a lot of
traffic. When we saw what it was my son put up a sign so that a
link just gets a notice "It is not nice to seal bandwidth and
copyrighted material" The first linker had that sign on his ebay
site for several hours before he realized it. We have not had
anyone link since.

Al, as I was reading the replies to this post (and actually before I got
to Susan's last post) I started wondering if these people linked to your
site or if they copied your pictures to another site. If any of them
linked right to your site, just think of the fun you could have!
The most innocent thing you could do is take a picture of some dead
flower and give it the exact same file name as the borrowed one. Replace
the picture on your web site for the duration of the auction. Of
course your other options are unlimited. A written notice of how you
really feel, a close up of an obscene hand gesture, where ever that Y
chromosome leads you.

I always wondered why Google had a listing like that now I know.

As far as Ebay deals being worth it, Ebay always gets it's money up front
and has the ability to freeze your bank account and credit card if they
think they've been cheated out of a penny.

However if these sellers are just linking to your web page photos you can
just put up a bunch of naked people with the same file name and the
thousands of Ebay nannys will make darn sure that seller is brow beat into
infinity and beyond.

I think they were copied in these instances. I have not come across this
linking issue before. But I haven't looked.

The VeRo program works very quickly within eBay. One of the people,
however had a website outside of eBay also and one of the pictures was
posted there but that is gone now too. And I have had a good night's sleep
and can spend the day repotting Phals and setting up automatic watering
zones.

I had a big problem with several sellers on ebay using my photos,
especially a guy that runs a store called Hea.ven.ly Orchid (I put the
periods in so the jerk wouldnt get some free Google advertising). Some
were even editing off my watermark. Ebay was very quick to remove the
offending auctions and they set me up with a new ebay user name that
puts a "report it now" type button at the bottom of every auction page.
It automates the whole reporting process and its fast.

If you have a lot of pictures online check that sellers store, I sent
emails to about 5-10 other people that he was stealing images from. He
has a lot of complaints against him now.

I found out a picture on eBay was taken from one of my web pages
without permission. I used VeRo and we'll see what results it will
have. The vendor is in the UK. Looks like VeRo is in the UK too. I
faxxed it last night, should have been start of business their time in
the UK...we'll see. As of this AM the photo is still there.
