Overhanging trees
There's trees & general overgrowth from my neighbour's garden hanging over
the fence. Some of the shrubbery comes a good three feet into my garden.
Does anyone know what the actual legal status is if I cut it back to the
level of the fence - I've heard various urban myths on the subject

the offcuts are your neighbours property, you have to give them back........

You can cut the branches back to the line of the boundary, but not
beyond.

And it's best to make sure you understand the growth habits of the
offenders, or you could end up with a worse eyesore -- you don't have
to go far to see a Leylandii hedge which has been cut back on one side!

You have to *offer* them back.
Just pushing them over the boundary will not improve neighbourly
relations.

Presumably you have tried asking him or her to cut them back
themselves? If, by any chance, you haven't it would be better to take
that approach first. Simply lopping bits of their trees and telling
them afterwards will lead to very bad feeling!

Also, of course, if the trees have preservation orders on them you
cannot touch them without "planning permission".

Unfortunately there's a "history" between me & the neighbour which started
with his telling me of his sexual desires about my 14 year old daughter and
ended (after solicitor's letters) with a psychiatrist being called out to
his house by the police.
He's as mad as a hatter (I honestly think he's insane) and so I and everyone
locally try not to speak to him.

Hi Manky
Do you happen to know if he owns the house or is it rented? If it is rented
then the owner/agent could be contacted and 'made responsible'. Two of my
daughters own houses and rent them out and I know that they are called on by
their letting agents to get things done. Likewise, another daughter who was
renting but has just bought her own place, called the letting agent to get
things done.

That's some history and I'm extremely sorry you've had to go through
that. I hope very much that your daughter is unaware of it.
Nonetheless, for your own sake, I would suggest that at the very least,
you put a note through his door or a registered letter through the
mail. In dealing with someone like that you want every bit of back up
you can get.

Yes I too sympathise. However, I assume that he is not as mad as a hatter
or insane on the basis that he was not sectioned by the psychiatrist.
If the daughter is unaware then I hope that she has been told to steer
clear.
I suppose this could be an event that happened several years ago so the girl
is probably now a bit more "street wise"
